Membership Terms and Conditions.

PLEASE READ THE TERMS AND CONDITIONS OF THIS AGREEMENT.

This is an Agreement between you (the “Member” or the “Challenger”), and Apex Coaching and Fitness Ltd (“Apex Coaching” or “Apex” or the “facility” or the “Gym”), a company registered in England and Wales (registration number 13999080), whose registered address is the Lower Ground Floor, 122 Bath Road, Cheltenham, Gloucestershire, United Kingdom, GL53 7JX.

By completing payment you confirm that you have read, understood, and agreed to the terms and conditions and all relevant policies outlined below.

You understand that your progress with your goals is dependent upon your effort, cooperation with Apex, consistency, and adherence to your relevant membership option both inside and outside of the group training sessions themselves.

Apex Gym Terms and Conditions

1. Membership Options.

1.1 6-Week Challenge (the “Programme”): A one-time payment of £247 grants access to 18 group coaching sessions over 6 weeks (3 sessions per week), including personal coaching, progress tracking, nutrition support, access to the members' area, and social events. The 18 group coaching sessions MUST be used within the six-week period.

1.2 6-Month Contract: The 6-month membership cost is £159 per calendar month. The minimum commitment is 6 months. After the initial 6-month term, the membership continues on a rolling basis, requiring a 28 calendar days notice period for cancellation, in line with the cancellation and termination policy.

1.3 12-Month Contract: the 12-month membership cost is £139 per calendar month. The minimum commitment is 12 months. After the initial 12-month term, the membership continues on a rolling basis, requiring a 28 calendar days notice period for cancellation, in line with the cancellation and termination policy.

1.4 Both 6-month and 12-month contracts (together the “memberships”) grant access to 3 group coaching sessions per week, personal coaching, progress tracking, nutrition support, access to the members’ area, and social events.

1.5 All three membership options allow attendance to 3 coaching sessions per week at Apex Gym. Unused sessions CANNOT be assumed to carry over from week to week or billing period to billing period. We are happy for members to catch up on their sessions after a time away due to holidays or emergencies, but we do not encourage carry-over outside of these circumstances.

2. Contract duration and renewal

2.1 You understand that by completing payment and agreeing to this contract you commit yourself to

2.1.1 Actively participate in the Challenge, and / or

2.1.2 a minimum contracted term of either of the memberships (depending on which membership option is selected)

2.2. You understand that this contract commences from the date of the payment is successfully processed. Both membership contracts are in force on a rolling calendar month basis.

2.3 You understand that once the initial minimum term of the membership contract ends you will automatically enter a rolling monthly contract, where a 28-day notice period is required for cancellation.

3. Payments

3.1 All contracts must be paid in advance. Membership options shall not be confirmed until payment has been received.

3.2 Membership fees are collected monthly via Stripe on the agreed date.

3.3 The 6-Week Challenge fee is payable in full upon sign-up.

3.4 You must ensure sufficient funds are available; failed payments may result in suspension of access until dues are settled.

3.5 You agree to purchase a recurring membership at Apex Coaching as an automatic charge to your credit/debit card every month for a minimum contracted period of either 6 months or 12 months (as appropriate), which then automatically enters into a rolling monthly contract unless you follow the cancellation and termination policy.

3.6 You hereby certify that you are the credit/debit card holder detailed when signing up for this contract via Stripe.

3.7 You understand that your contract will be deactivated if no payment has been received more than 28 calendar days after the payment due date.

3.8 Apex reserves the right, at Apex’ discretion, to change your monthly membership option fee. If this happens, you will be notified by email at least 28 days before the change will become effective. You are able to cancel your membership within this period, and if Apex does not hear from you within the period, the new monthly membership option fee will apply automatically.

4. Cancellation and Termination Policy

4.1 Please read carefully through the cancellation and termination policy below. If for any reason any member is not able to follow this policy, Apex advises that member not to sign up for a membership option.

4.2 6-Week Challenge: Non-refundable once commenced, except under the money-back guarantee terms.

4.3 The memberships: Early termination within the initial term is not permitted. Post initial contractual term, a 28 calendar days notice is required for cancellation.

4.4 Cancellation of the memberships prior to its relevant minimum contracted term’s expiration date requires an early termination fee. The early termination fee is equal to 50% of the remainder of the contractual term. Please ensure that your membership option is chosen appropriately on this basis.

4.5 Any payments within this 28-day period will be processed as normal and are non-refundable. The members are able to continue at the Gym for a month after their final payment has been processed.

4.6 Cancellations must be submitted in line with our Cancellation process as advised by your Apex Coach(es).

4.7 Paid-in-full / upfront paid memberships are non-refundable.

5. Money-Back Guarantee

5.1 To qualify, the Challengers must attend all 18 sessions in the six weeks, adhere to the nutrition plan as advised by the Coach(es), and actively engage in progress and nutrition tracking through relevant software every day, and check in with their Coach(es) weekly for the full duration of the programme.

5.2 Claims must be submitted within 7 days post-programme completion with supporting evidence.

6. Memberships Pauses

6.1 Membership pauses are not permissible during the initial contracted period of either 6- or 12-month membership options.
 

6.2 Membership pauses are only granted in exceptional circumstances by Apex Coach(es) and / or staff (e.g ongoing ill health, pregnancies, etc.). Holidays under 2 months are not permissible for pausing a membership.

6.3 Once the initial contracted period of the relevant memberships has expired and a rolling monthly contract has been entered into, the memberships pauses are limited to 60 days (2 payments) per calendar year, in 30-60 day increments only.

6.4 A written request must be submitted at least 28 days prior before the next scheduled payment date. Any requests received outside the 28 days window cannot be processed until after the next scheduled payment.

6.5 Upon expiration of any pause period, memberships will automatically reactivate and the payment will be taken automatically at the next scheduled payment date.

6.6 Should you choose to cancel the membership during the membership pause period, you must follow the cancellation and termination policy.

7. Class bookings

7.1 You are required to book group coaching sessions (“classes”) in advance using appropriate software (TeamUp).

7.2 Classes’ bookings open seven calendar days ahead of the class start date and time.

7.3 Any issues you may experience with the booking process / systems, you must message your assigned Coach first. Apex coaches have the authority to make any decisions related to your membership options and class booking allowance.

7.4 Only three classes are permissible for members to be utilised each week unless specified otherwise.

7.5 Waitlist space counts towards the 3 classes' weekly allowance.

7.6 Apex’ policy on waitlisted members being added to classes is:

7.6.1 One hour before the start of the class and beyond: the waitlisted members will be automatically added to the relevant class based on the order in which they joined the waitlist.

7.6.2 Less than one hour before the start of the class: all waitlisted members must accept their space in the class if one or more become available. Those members will have a 15 mins window to accept the space on the relevant class and will be notified by TeamUp via their registered email.

7.7 If you don’t turn up to the class, your attendance will be marked as a “no-show”. This will count towards your 3 classes’ weekly allowance. You will not be able to book an extra class that week unless it was a genuine emergency or agreed by Apex Coach(es) and / or staff.

7.8 Class cancellations should be made at least one hour before the start of the session to allow others to attend. Late cancellation will result in the loss of a session and count towards the weekly class allowance.

7.9 Late cancelled classes and no-showed sessions will not be carried over to the next week unless permitted by your Coach or Apex Staff.

7.10 If Apex notices you consistently late cancel classes or do not show up, Apex may issue a warning; however, Apex trusts that you will take the steps to promptly cancel your class and manage your bookings with care.

7.11 In extreme circumstances where Apex Gym must cancel classes, you will be given the option to be booked to another class or add an extra session in the week of the cancellation taking place or the following week.

7.12 Class bookings are non-transferrable to another member.

7.13 Apex reserves the right to modify class schedules, including instructors and formats, without notice.

7.14 I understand that Apex opening times are subject to change and will vary from the regular schedule over the holiday and Bank Holiday periods.

7.15 In exceptional circumstances where Apex is unable to find appropriate staffing cover due to the short-term illness of Apex Coach(es), Apex retains the right to amend its opening hours. In these circumstances should any class get cancelled, the affected members will be refunded their lost session. Members can use that refunded session either in the week of cancelled sessions or the week after.

8. Facility Usage

8.1 You must adhere to gym rules and respect the Gym equipment and fellow members at all times.

8.2 You must keep the Gym equipment clean, and wipe the surfaces after use when appropriate.

8.3 Apex Coaching cannot accept responsibility for any loss or damage to personal property (including cars parked on the street outside the Gym).

8.4 For safety reasons, no member is allowed to keep their personal bags on the gym floor. All bags must be stored in the designated storage unit.

9. Health and Safety

9.1 Members must be 18 or older.

9.2 You should consult a healthcare professional before starting any new fitness programme, especially if you have any health concerns / conditions.

9.3 Any existing medical conditions or injuries must be disclosed to the Apex Coach(es) / staff.

9.4 All members must attend either an in-person or an online introduction session. Apex Coaching cannot accept any liability for any claim or personal injury if any member uses the gym equipment without having undertaken an introduction session with one of our Apex staff.

9.5 There are inherent risks involved in participating in strenuous exercise. You  participate at your own risk. If any member sustains or claims to sustain any injury whilst participating in the programme or the memberships, that member acknowledges Apex and Apex staff are not liable for injuries sustained on the premises, barring gross negligence or an intentional act of the Coach(es).

9.6 All members must adhere to all instructions given to them by Apex staff.

9.7 You must not use the facilities under the influence of alcohol, narcotics, tranquilizers or any medication or other substance that may affect your ability to exercise safely. If Apex staff deem any member(s) to be not in the right state to use the facilities adequately, then Apex staff reserve the right to ask that member(s) to leave and terminate their membership option with no refund.

9.8 To ensure everyone’s safety at the Gym, no one must block or interfere with the fire / emergency exits, or tamper with the fire extinguishers (unless in a genuine emergency).

9.9 Smoking, including e-cigarettes, is not permitted at the Apex Gym. Any member found to be in breach of this rule may have their membership option terminated with no refund.

9.10 Clothing such as denim, boots, flip-flops / sandals, or workwear are not permitted unless during a social event held at the Gym.

10. Data Protection

10.1 Apex collects and processes personal data in accordance with the UK General Data Protection Regulation (GDPR).

10.2 Your information will not be shared with third parties without consent.

10.3 There are certain email and SMS communications that are necessary for Apex to send to all members, in connection with their membership. To do so Apex will process members’ personal data for the purposes for performing the Gym’s contractual obligations to the members under the terms of the Memberships. You cannot opt out from these communications.

10.4 You may opt out of email and SMS communications that Apex may otherwise send for promotional or marketing purposes. Should you do so, Apex cannot be held responsible for any loss incurred by you not receiving gym-related communications.

10.5 You can contact Apex with any queries or concerns by emailing info@apexcoaching.co.uk from (or quoting) the email address that Apex holds for you.

11. Amendments and other clauses

11.1 Apex reserves the right to amend these terms and conditions and the membership agreement at any time. It is your responsibility to check online at regular intervals for changes to these documents.

11.2 Members may be notified of significant changes via the members' portal or email.

11.3 Only you, the person named on the membership option, can benefit from this Agreement.

11.4 If any of the terms of this Agreement are invalid, unenforceable or illegal the remaining terms can still be enforced.

11.5 The agreement is governed by the law of England and Wales.
